Title: Balisong State Laws
Post by: Stitch on August 28, 2008, 03:48:23 PM
I know that a basilong (also referred to as a "Butterfly Knife") is legal here in PA, but I was wondering which states consider it illegal. Just so I know which states I "can't" live in.

EDIT: Below is mine.

EDIT: sorry, had to edit the topic title. The misspelling was driving me nuts.  -- Demosthenes

For the record, it's not illegal for you to live in my state.  But if you ever do, I'll kick your ass.

Have you considered having it surgically removed?

Such hostility.

Dude.  Seriously.  Would you want Stitch living in YOUR state?

Yeah.  That's what I thought.

Yeah, thanks. That means a lot to me.
So far I can live in Minnesota, though it will be painful.

1. It's Balisong, not "basilong"

2. Knives are not regulated at the state level in Pennsylvania. So you may get a ticket in some cities for your butterfly knife still.

3. Pennsylvania - Pa. C.S.A. 18.908. Prohibited offensive
   weapons. (a) Offense defined.--A person commits a
misdemeanor of the first degree if, except as authorized
by law,  he makes, repairs, sells, or otherwise deals in,
uses, or possesses any offensive weapon. (b) Exception.--
It is a defense under this section for the defendant to
prove by a preponderance of evidence that he possessed of
dealt with the weapon solely as a curio or in a dramatic
performance, or that he possessed it briefly in
consequence of having found it or taken it from an
aggressor, or under circumstances similarly negativing any
intent or likelihood that the would be used unlawfully.
   (c) Definition.--As used in this section "offensive
weapon" means... any... dagger, knife, razor or cutting
instrument, the blade of which is exposed in an automatic
way by switch, push-button, spring mechanism, or
   otherwise
...

In Texas, the opening mechanisms for automatic knives also includes centripetal force. The way the law is worded makes it a catch-all, meaning you're at the mercy of any officer who sees your knife.

You can come to Kansas if you want, Stitch.

But trust me, you don't. And anyway, they're illegal here because of the red part.

Kansas - Article 42. Crimes Against the Public Safety;
Weapons Control. Section 21-4201. Criminal use of weapons
   is knowingly...
(1) Selling, manufacturing, purchasing, possessing, or
carrying any... knife commonly referred to as a
switchblade knife, which has a blade that opens
automatically by hand pressure applied to a button,
spring, or other device in the handle of the knife, or any
knife having a blade that opens or falls or is ejected
into position by the force of gravity or by an outward,
downward or centrifugal thrust or movement...
(2) carrying concealed on one's person, or possessing the
same with intent to use unlawfully against another, a
dagger, dirk... dangerous knife, straight-edged razor,
stiletto, or any other dangerous or deadly weapon or
instrument of like character, except that an ordinary
pocket knife with no blade more than four inches in length
shall not be construed to be a dangerous knife, or a
dangerous or deadly weapon or instrument...

That is really sad. I live in PA.

I don't much care for laws against sharp objects. I've started collecting. I've got 4 swords, one of which is a replica for Blade, 2 short swords, 3 daggers (two of which are ceremonial), and a switch blade I carry with me everywhere.
Earlier today I was in a small gun/bicycle shop in town, and there is this delicious Cutlass Machete. Though, a Neck Knife would be lovely too.

Thanks. Makes sense, seeing as how the longer version is a balisword.

Hey you don't wanna fuck with my butterfly. Last year on Memorial Day, I was drunk with my neighbor, we were bullshitting, and I ended up getting my left hand sliced real good. Needed 17 stitches.

People here carry concealed handguns.  We don't need no stinking butterfly knives.  Oooooooh, "butterfly" knife, how intimidating.

Thought this thread was about state regulations regarding a type of Philippino food.

Thread does not deliver.

That may bee, but as my ant would say, "That's an equine of a variant wavelength."

I suck at puns so I'll just stick to point of the thread.

Stitch can live in North Carolina... but... um... well... what color is your neck again?

I don't know, I haven't seen my neck in a while. My hair goes down to my back. But, it's not a mullet, whatever that counts for.
