I think this is pretty ridiculous, he sues everyone but Microsoft. That is probably because he worked there/helped create it. But owning intellectual rights to parts of the internet? Really?

If you own a patent, then you have the right to sue should someone else infring on that patent. Its the entire reason for patents, to protect the intellectual property.

Now does Paul Allen need to sue for money? No. And he probably isn't doing it for money. It is to stop the infringement on the patents, and the best way to do that in the business world is not to ask politely, but to sue the pants off them as to make an example. It's a harsh thing to many of us pleebs, but you do not establish empires in business by being nice.

True, but wouldn't advancements on the internet and the way it works fall under public domain? I mean, Linux is a modified Unix, Unix is the base code of the internet is it not? So why shouldn't advancements on the way the internet works be covered by a copyleft instead of patents? I just think that the pride of having made such advancements used to be enough for programmers but now it has become a struggle of who can get richer faster.

Private companies invest far more into the internet than the public, and not everything using Linux or Unix is free. As for the programmers, I know many programmers, some of which are VERY good, and while all take pride in their work, none of them work for free and they all want more.

Methinks he's going to lose if anyone challenges it. They've spent so long allowing it to happen that it would be impossible to claim that it's for protection of the IP and patents or prove substantial loss due to violation.

The OS's consisting of Linux or Unix only cost what it took to produce, no profit is made by those that distribute it, that is what the copyleft on such material guarantees. Any software developed from a Linux or Unix kernel is only legally distributable by that guideline. So in all essence all Linux or Unix software is free from the standpoint of the developer.

Incorrect. Linux does not share any code with Unix.

Linux, yes. But unless it's an open source flavor of Unix, there are still intellectual property rights to deal with. Not all Unix is free. Most, in fact, are not.
